Our store is hosted on woocommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Section 6 – Accuracy Of Billing And Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Section 7 – Payment terms

For Commissions the Seller requires a deposit of 50% of the total purchase price for all purchase orders upon Buyer’s placement of the order. After 48 hours of Seller’s receipt of the deposit, the deposit will be NON-REFUDABLE. Purchase orders received without a deposit are generally held from production pending the receipt of the payment. Unless different payment terms have been extended to Buyer in writing, payment of the balance is due upon completion of the order, prior to shipping. Seller will send a notification to Buyer that the order is complete, together with an invoice noting balance of the purchase price due upon receipt, and, Buyer shall promptly remit payment of the purchase price balance to Seller. The payment remittance address and payee will be listed on the invoice. For all orders completed and not paid-in-full within two weeks of estimated completion date, item will be restocked and buyers delivery date will be reset to the full current lead time

Section 8 – Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Section 14 – Limited Warranties; Limitation Of Liability

Products are sold with a limited warranty against manufacturer defects in materials and workmanship for a period of one year from the delivery date. Seller reserves the right to repair or replace defective Products at its sole discretion. This limited warranty does not extend to other materials supplied by the Buyer or damage caused by shipping, accident, abuse, misuse, negligence, cleaning, or normal wear and tear. This warranty applies to the original Buyer only and is not transferrable. All other warranties express or implied are excluded. Seller reserves the right to modify its limited warranty at any time in its sole discretion.

In no case shall Fiona Gall, Emerald Faerie, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Section 17 – Cancellations

The buyer must provide Seller with a written request for any cancellation. Seller will attempt to accommodate requests for cancellations but cannot guarantee stoppage of shipment for stocked product. All deposits are non-refundable after 48 hours of receipt. If work has been performed, any costs incurred by the seller  will be charged to the buyer, which may include a cancellation charge up to the price of the product.

Section 18 – Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

Buyer shall hold all such information in strict confidence, shall not use or divulge to any third person or entity any such confidential information, and any and all copies of such confidential information shall be returned to Seller promptly upon Seller’s request.

Returns & Refunds

We hope that you are delighted with your purchase, however if you are not we will happily organise an exchange or refund for you, providing you notify us in writing  within 48hrs from date of purchase.

Shipping charges (including return shipping) are non-refundable.

Exemptions

The following items are non-cancellable, non-refundable and non-exchangeable:

-Personalised items that are specially made, or ordered, with your choice of name, message or other customised aspect that makes the item unique to your requirements and therefore cannot be re-sold.

-Sale Items (unless faulty)

We strongly advise you to thoroughly check your goods upon receipt. To protect your interests, any claim concerning short delivery and/ or damaged goods and/ or defective goods found on delivery must be notified on the delivery date via email at shop@emeraldfaerie.com or by phone +44 (0) 7769793063. We do not accept any claims for damage caused by you the customer.

How To Exchange Or Refund A Product

To arrange an exchange or refund, please email shop@emeraldfaerie.com quoting your order number, name and address, details of the product, the reason for return (this helps us improve our offering) and whether you require a refund or replacement. We will then advise on next steps.

We will require you to return the goods in their original, unworn, unused condition and in the gift box / packaging that they came in to the address below:

The item is your responsibility until it reaches us and so for your own protection, we recommend that you return the item via Royal Mail registered delivery or other ‘signed for’ service, and you should also obtain proof of postage. We cannot be held responsible for returns that are lost in transit.

If you are returning an item to us for a refund or an exchange, the cost of returning the item to us is your responsibility. However, where the item you received was sent in error or we deem as faulty, then we will refund your postage costs (providing we are notified of the fault within the timescales detailed above).
We will not exchange goods that have been worn, do not have their original packaging or show obvious signs of wear or abuse. In this instance, the goods will be returned to the buyer.

In the interests of fraud prevention, your refund will be issued by the same method that you paid within 28 days of receipt of the return.

Late Or Missing Refunds

If you haven’t received your refund within 28 days of returning the goods, first check your bank account again. Then contact your credit card company as it may take some time before your refund is officially posted.

Email marketing messages & subscription

Fiona Gall, is a designer-maker who creates under the name of Emerald Faerie. Opulent & decorative lighting and jewellery made from metal, glass and repurposed antique finds. Creating one-off sculptural art lighting pieces and chandeliers. She creates custom designs for private, retail and hospitality clients in the UK & USA. Each piece is handmade to order in her studio in Kent.
